Terms of Use

These Terms of Use ("Terms") govern your access to and use of SizzleAir, including the website at sizzleair.app, the SizzleAir macOS app, downloads, licenses, updates, and related support services.

By downloading, installing, purchasing, activating, accessing, or using SizzleAir, you agree to these Terms. If you do not agree, do not use the website or the app.

You may use SizzleAir only if you can legally enter into a binding agreement and use the product in compliance with applicable law.

If you are using SizzleAir on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms.

SizzleAir is a native macOS menu bar app for Apple Silicon MacBook Air. It monitors thermal state and can provide optional feedback through heat-themed audio, supported trackpad haptics, and subtle screen animation.

SizzleAir is a lightweight utility and novelty product. It is not a hardware repair tool, cooling system, benchmark tool, medical device, safety system, or professional diagnostics platform.

SizzleAir is built and tested for Apple Silicon MacBook Air running macOS 13 or newer.

Unsupported devices, unsupported macOS versions, Intel Macs, virtual machines, modified systems, and non-target Mac models may not work correctly. We are not responsible for issues caused by unsupported hardware, unsupported software, system modifications, third-party tools, or changes made by Apple.

Experimental precise temperature sensor features, if exposed in the app, may vary by model and macOS version. The stable product promise is thermal feedback, not exact sensor precision on every machine.

Subject to these Terms and payment of applicable fees, SizzleAir grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app for your own personal or internal business use on devices you own or control.

Unless otherwise stated at checkout, one SizzleAir license supports up to 3 activations.

You may not:

• resell, sublicense, rent, lease, distribute, or make SizzleAir available to third parties;
• share license keys publicly or with people who are not allowed to use your license;
• bypass, disable, abuse, or interfere with license checks, activation limits, update checks, or security features;
• copy, modify, reverse engineer, decompile, or attempt to extract source code from the app, except where such restriction is prohibited by applicable law;
• use SizzleAir for unlawful, abusive, fraudulent, or harmful purposes.

SizzleAir is offered as a one-time purchase unless clearly stated otherwise at checkout.

Displayed prices may be exclusive of applicable taxes. Polar calculates and displays any taxes before payment is completed.

Prices may change for future customers at any time. Price changes do not change rights already granted under a completed purchase.

Purchases, payment flows, license key delivery, and customer portal access may be handled by Polar and its payment processors. Their own terms and policies apply to those services.

Because SizzleAir is a digital product, refunds are generally not available once a license has been issued and delivery or use has started, except where required by applicable law.

As a voluntary commercial policy, if SizzleAir does not function on a supported Mac, contact us at contact@sizzleair.app within 14 days of purchase. We may try to troubleshoot the issue first. If the issue cannot be resolved and the license is deactivated, we may provide a refund to the original payment method.

Refunds are not promised for unsupported devices, unsupported macOS versions, buyer's remorse, feature requests, expected performance improvements, hardware damage, or misuse, unless required by applicable law.

Nothing in these Terms limits mandatory consumer rights that cannot be waived.

SizzleAir may provide updates, bug fixes, improvements, or compatibility changes, including updates delivered through Sparkle or other update mechanisms.

Unless required by law or explicitly promised at checkout, we do not guarantee any specific update schedule, feature roadmap, compatibility period, or maintenance period.

SizzleAir may depend on third-party platforms, infrastructure, and services, including macOS, Apple system APIs, Polar, payment processors, Sparkle, hosting providers, download hosting, email providers, and support tools.

Your use of third-party services is governed by their own terms and privacy policies. We are not responsible for third-party outages, policy changes, account actions, payment processing issues, API changes, hosting failures, or platform changes outside our control.

You are responsible for:

• using SizzleAir only on supported devices and operating systems;
• keeping your Mac, license key, and local account secure;
• choosing appropriate audio, haptic, and screen animation settings;
• using judgment about where and when feedback effects are enabled;
• maintaining backups and protecting your own data.

SizzleAir does not change macOS performance settings, cooling behavior, voltage, clock speeds, or thermal limits. It does not prevent heat, throttling, battery drain, performance loss, or hardware wear.

SizzleAir can produce sounds, supported trackpad haptics, and visual screen effects. You can disable these effects in the app.

If you are sensitive to sound, haptic feedback, visual effects, motion, smoke/flame-style animation, or screen changes, do not enable the relevant features. You are responsible for using settings that are safe and comfortable for you and for people around you.

We may suspend or terminate access to SizzleAir, disable a license, refuse support, or revoke rights granted under these Terms if we reasonably believe you have breached these Terms, used the product unlawfully, abused the license system, created security risk, committed fraud, or misused the product.

You may stop using SizzleAir at any time. Some local data may remain on your Mac unless you remove it.

SizzleAir, including the app, name, logo, brand assets, website content, visual design, audio assets, documentation, and related materials, is owned by us or our licensors and is protected by intellectual property laws.

All rights not expressly granted in these Terms are reserved. You may not copy, imitate, reproduce, distribute, or create derivative works from SizzleAir branding, assets, website content, or app materials without prior written permission.

Open-source components, if any, remain governed by their own licenses. Required notices may be included with the app, documentation, or distribution.

Our Privacy Policy explains how we handle information in connection with SizzleAir. By using SizzleAir, you acknowledge the Privacy Policy available at https://sizzleair.app/privacy.

SizzleAir is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

We do not warrant that SizzleAir will be uninterrupted, error-free, secure, compatible with every setup, suitable for every workflow, or capable of producing exact thermal readings on every device.

We do not warrant that SizzleAir will cool your Mac, improve performance, prevent throttling, prevent hardware damage, prevent data loss, or detect every thermal condition.

To the maximum extent permitted by law, SizzleAir will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, use, data, hardware, or device functionality arising out of or related to your use of the website or app.

To the maximum extent permitted by law, our total liability for claims arising out of or related to SizzleAir will not exceed the amount you paid for the relevant product or service giving rise to the claim.

Nothing in these Terms limits liability or consumer rights that cannot be excluded under applicable law.

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of SizzleAir, violation of these Terms, violation of law, or infringement of third-party rights.

We may update these Terms from time to time. If we make material changes, we may update the date on this page and, where appropriate, provide additional notice.

Continued use of SizzleAir after updated Terms are posted means you accept the updated Terms.
